Can a real estate agent be the loan officer on the same deal in South Carolina?

No rule against it found

By Gary Basin, co-founder of Ike · Reviewed

We found no South Carolina rule against a real-estate agent acting as the mortgage loan originator on the same purchase. The two mortgage licensing laws contain no prohibition, and the real-estate license law requires written disclosure.

What South Carolina requires

  • Give the written disclosure S.C. Code 40-57-710(A)(15) requires.
  • Hold an active South Carolina MLO license sponsored by a licensed mortgage company.

What the rule says

receives compensation in a real estate transaction or directly resulting from a real estate transaction from more than one party except with the full knowledge and written disclosure to all parties
S.C. Code § 40-57-710(A)(15). South Carolina Real Estate License Law grounds for discipline, read October 15, 2026.
In addition to the activities prohibited by other provisions of state or federal law, it is unlawful for a person in the course of a mortgage loan transaction to: (1) misrepresent the material facts or make false promises likely to influence, persuade, or induce an applicant for a mortgage loan or a mortgagor to take a mortgage loan.
S.C. Code § 40-58-70. South Carolina Licensing of Mortgage Brokers Act prohibited activities, read October 15, 2026.
In addition to the activities prohibited by other provisions of state or federal law, it is unlawful for a person licensed pursuant to this chapter, in the course of a mortgage loan origination, to: (1) misrepresent or conceal the material facts or make false promises likely to influence, persuade, or induce an applicant for a mortgage loan
S.C. Code § 37-22-190(A). South Carolina Mortgage Lending Act prohibited activities, read October 15, 2026.

What we have not settled

Interpretive letters from the Department of Consumer Affairs and the Board of Financial Institutions have not been swept.

What applies in every state

  • Both licenses must be active. The mortgage side is an individual MLO license, sponsored by a licensed mortgage company, with the SAFE test, 20 hours of education and a background check behind it.
  • Federal law sits above the state rule. RESPA Section 8 bars pay for a referral, and Regulation Z sets what a loan originator may be paid for. Compensation on the mortgage side is for origination work performed. The RESPA and referral-fee explainer walks through it.
  • The lender on the loan has its own rule. FHA permits the dual role since 2022. Conventional lenders decide file by file in writing.
  • The buyer keeps the right to choose any lender, and the disclosure says so.
